Cargo Terms and Conditions
  1. LBC's liability for loss, damage, or delay shall be as follows:
    • A. For lost or damaged shipments with NO DECLARED VALUE, liability shall only be limited to refund of freight fee, regardless of the actual content of the parcel.
    • B. For lost or damaged shipments with DECLARED VALUE, liability shall only be limited to the value declared in the Invoice, regardless of the actual/declared content of the package, and refund of freight fee.
    • C. For declared value in delivery, liability shall only be limited to refund of freight fee.
  2. LBC shall not be liable for loss, damage, or delay arising from act of God, force majeure, acts of government authority, or shipper’s breach of this contract. LBC shall be not liable for moral and exemplary damages, and consequential damages, unless, the amount of foreseen consequential damage is declared during the acceptance and higher freight fee is paid.
  3. Shipper warrants the following:
    • A. All information are true and correct, particularly, names and addresses of shipper and consignee, as well as, the declared contents and value of the shipment.
    • B. Shipper shall not include no hazardous or prohibited items, e.g., inflammables, firearms and parts, animals, illegal drugs, live animals, and all other items prohibited by law or government, or requires government permit for its transport.
    • C. The consignee or any person of sufficient age and discretion will be at the given address to receive the shipment at the agreed day of delivery and shipment may be released to the latter in the absence of the consignee.
  4. Shipper agrees to check and verify the status of his shipment at any LBC branch, customer care hotline, or www.lbcexpress.com within five (5) days from date of acceptance the status posted in the Track and Trace in the mentioned LBC website. If undelivered, the status posted in the Track and Trace in the mentioned LBC website is deemed sufficient notice to the shipper and the latter must claim his shipment within thirty (30) days from non-delivery, LBC shall dispose the same in a manner it sees fit and apply the proceeds, if any, for storage fee from the date of posting of non-delivery until claimed or disposed.
  5. In case shipment is not delivered to the original consignee, delivery to a new address or return to sender as requested by the shipper shall be considered totally new transaction and corresponding freight fee shall apply.
  6. LBC may open and check the shipment prior to acceptance in the presence of the shipper or authorized representative to ensure that shipment contains no unauthorized or prohibited content. LBC reserves its right to refuse acceptance which, in its discretion, would be violative of its policies and pertinent laws.
  7. Consignee or any person of sufficient age and discretion shall check the shipment upon receipt, shipment is deemed delivered and received in good order and condition in the absence of complaint or noted damage immediately communicated to LBC.
  8. For COD-COP transactions, LBC, not being privy to the transaction, shall not be liable to expected income or value of the shipment returned or refused to accept by the consignee for whatever reason. Shipper agrees that the delivery and collection of his/her COD_COP shipment shall be governed and subject to local/ordinance implemented at the place of origin and destination.
  9. Shipper agrees that the payment collected for COD-COP transaction shall be remitted to LBC through its money remittance services subject to below terms and conditions of remittance.
  10. Transportation of physical media (documents, computers) containing personal data does not constitute processing of that data.
Money Remittance Terms and Conditions
  1. Money remittances and financial services are governed by AMLA provisions and customers agree to comply therewith including proper disclosure and sharing of personal and sensitive information. Customers warrant that all the required information given, including proof of personal identification, are true and correct. LBC reserves its right to refuse acceptance if it finds the transaction violative of AMLA and other pertinent laws.
  2. LBC reserves its right to stop, suspend, and hold the release of money remittance without prior notice if LBC identifies the customer from the watch-list of scammers, or finds reasonable suspicion that the customer is a scammer or whenever LBC deems it necessary in compliance with AMLA.
  3. Sender understands the importance of the assigned TRACKING NUMBER and/or PINCODES and pertinent details of the transaction, indispensable for the release and withdrawal. Sender assumes full responsibility to notify and share the TRACKING NUMBER and/or PINCODES and transaction details ONLY to the intended consignee. Sender holds LBC free from any liability for the release to consignee who presented the TRACKING NUMBER and/or PINCODES and transaction details which turned out to be a scam/fraud.
  4. Sender understands and agrees that remittance can be released/withdrawn immediately at any LBC branches nationwide, as well as, remittance affiliates. Request for specific LBC branch for release shall not be considered exclusive but merely preference and shall not be a bar for consignee to withdraw at other LBC branches or remittance affiliates.
  5. Request for refund, amendment, or cancellation must be made at the branch where transaction was made prior to release or withdrawal and subject to corresponding fees. Sender must present the Invoice/Remittance Form; otherwise, request shall be denied.
  6. Sender agrees to check and verify the status of remittance at any LBC branches, customer care hotline, or www.lbcexpress.com within five (5) days from date of acceptance. If unclaimed, the status posted in the Track and Trace in the mentioned LBC website is deemed sufficient notice to the sender and the latter must go to the branch where the transaction for refund, amendment, or cancellation of the remittance within thirty (30) days from acceptance subject to additional charges provided in the immediately succeeding section.
  7. If remittance or payment of a COD-COP transaction is remained unclaimed after thirty (30) days from date of transaction, sender agrees that an administrative fee of Php 300.00 or five (5%) percent of the remittance amount, whichever is higher, per month shall be assessed and deducted from the unclaimed remittance.
  8. In case of loss or wrongful release due to the direct fault or gross negligence directly attributable to LBC, liability will only be limited to the remittance actually lost or wrongfully released to the exclusion of all other damages.
  9. Whenever applicable, LBC shall not be liable for the filing and payment of taxes due on the money remitted. It shall be shouldered by the beneficiary.
Terms and Conditions Common to Cargo and Remittance

Any court action arising from this contract shall be brought in the proper court of Paranaque City to the exclusion of all other courts. All claims must be filed in writing within the thirty (30) days from the date of transaction; otherwise, the same shall be denied. Sender of his/her representative, if any, warrants that he/she has full legal capacity and authority to enter into this contract, and understood and agreed to the full terms and conditions hereof, as well as the terms and conditions of LBC found on its website and displayed in its branches.

Introduction

LBC EXPRESS GROUP (“LBC”), respect your privacy and recognize the need for appropriate measures to protect and manage your personal data entrusted to us. Our Privacy Policy follows, and is consistent with, the Data Privacy Act of 2012 (DPA), its Implementing Rules and Regulations (IRR), other issuances of National Privacy Commission (NPC), as well as other relevant laws of the Philippines.

Personal data refers to all types of personal information, sensitive personal information and privileged information. Personal information refers to “any information, whether or not recorded in any form, from which the identity of an individual is apparent or can reasonably and/or directly be ascertained by the entity holding the information, or, when put together with other information, would directly and certainly identify an individual”.

This Privacy Policy pronounces how LBC process (how it collects, uses, shares, and keeps) and protect your personal data. It also provides the steps that you can take should you wish for any change in how we use your personal data, or if you want us to stop using your personal data.

Why do we collect your personal data?

To enable us to comply with our corporate policies in relation to data subjects as well as with the requirements under the Data Privacy Act, it is important that we collect, use, store and retain your personal data only as is reasonable and necessary for a declared and specific purpose stated in the pertinent consent forms.

In general, we are using your data for any of the following purposes:

  • To evaluate and/or fulfill your transaction with us;
  • To comply with LBC's obligations under law and as required by government organizations and/or agencies such as, but not limited to, the following: NPC, BSP, BIR, HDMF or Pag-IBIG, PhilHealth, SSS and so on;
  • To comply with legal and regulatory requirements or obligations; and
  • To perform such other processing or disclosure that may be required under law or regulations.

Other uses by nature of our transactions:

In addition, from the general uses mentioned above, we may use your personal information depending on your transactions with us in any of the following means:

A) When you want to become a part of our team (for employment):

  • To consider and evaluate your suitability for employment, and with your permission, inform and consider you for future job opportunities that may be of interest to you;
  • To communicate with you about your employment application;
  • When hired, to process your data necessary for your employment such as, but not limited to, payroll, benefits application, allowances and refunds processing, tax processing, retirement benefits, and other purposes that demand processing of your personal data (e.g., business travels, anniversaries, social activities, emergencies, and so on);
  • When hired, for your performance evaluation and career development including seminars, trainings, workshops, and compliance monitoring;
  • When hired, for employee engagement programs to improve employee experience or satisfaction;
  • When hired, to process your data to execute business processing such as preparation and/or approval of business documents and any other functions that are directly related or incidental to your job and the handling of your personal data; and
  • Upon separation, to process your data for the exit interview and preparation of final pay.

B) When you are a customer (for retail or corporate customers):

  • For you to remit and accept money remittance;
  • For you to schedule a pick-up for delivery and/or to identify and contact you, verify and confirm your request;
  • To be able to deliver the shipment to the consignee;
  • For you to receive product reviews or products/services;
  • To generate statistical insights;
  • To process feedback or reviews (through surveys or polls) in order to improve customer experience/satisfaction;
  • To respond to specific complaints, inquiries, requests for quote or requested information;
  • To send you notifications, updates, or reminders regarding your account and/or services timely and efficiently; and,
  • To determine your preferences, and to inform you about our quality and service improvements based on your preference and interest initially provided to us or made aware of, with which you can opt out should you prefer not to receive those notifications.

C) When you are a vendor, a potential vendor, or a contractor (for vendors/suppliers or future partners):

  • To contact you when we require your services;
  • To carry out due diligence on services rendered in accordance with legal, regulatory obligations or company policy;
  • To manage, assess, and improve our relationship with vendors or service providers;
  • To assess the performance and effectiveness of services provided; and
  • To process and strengthen our relationship by having good communication.
What type of personal data do we collect?

We collect information to provide you with details and information regarding our product, services, and promotions. We process information also to respond to your enquiries or manage future interactive user function. The common type of data collected by LBC from you generally includes the following:

  • Personal information such as full name, home addresses/billing address/shipping address, including photos as proof of delivery, e-mail address, employment information, telephone, other personal contact numbers;
  • Sensitive personal information such as date of birth, nationality, marital status, gender, and education;

You are responsible for ensuring that all data, whether personal information, sensitive personal information, or privileged information, you submit to LBC is accurate, complete, and up-to-date.

How we collect, acquire or generate your data?

We collect data when you:

  • Fill-out our forms (e.g., feedback form, resume form, contact form, supplier accreditation form, remittance/encashment form, etc.);
  • Disclose your personal information through chat threads, phone calls, emails, SMS or verbal communication with our authorized representatives; and
  • Through social media services (e.g., Jobstreet, Facebook, Twitter, LinkedIn). We may also collect personal information about you from social media platform, public comments — but we will never ask you to supply personal information.
  • Sign up for our other digital-enabled services like apps, on-site POS and other digital interfaces that require a digital sign-up process.

Do our websites use web analytics?

Our website, lbcexpress.com, engage third-party service provider, Havas Media, to analyze the web traffic data for us. Both lbcexpress.com and lbcexpressholdings.com use cookies. Only lbcexpress.com uses web beacons.

Cookies are small files that our website puts on your personal computer (PC) to store information about your preferences. Cookies can improve your browsing experience by allowing our website to remember your preferences or letting you avoid signing in each time you visit our website. These sites are operated by independent entities that have their own privacy policies which you should review as well. LBC's Privacy Policy does not apply to such other sites or to the use that those entities make of your information. LBC has no control over the content displayed on such sites, nor over the measures, if any, that are taken by such sites to protect the privacy of your information.

Who do we share your personal data with?

As a general rule, we do not share your data to third party except in limited circumstances as listed below.

By giving your consent, you authorize LBC to disclose your personal data to accredited/affiliated third parties or independent/non-affiliated third parties, as necessary:

  • The use or disclosure is reasonably needed, required or authorized by law (such as for criminal investigation, as requested by court of law);
  • To our affiliates, subsidiaries, parent companies, organizations, or agencies including their sub-contractors or prospective business partners that act as our service providers and contractors;
  • To law enforcement and government agencies;
  • And third parties with whom we share this personal data are required to use your personal data in a manner that is consistent with this Privacy Policy.

However, these companies may only use such personal data for the purposes disclosed in this Privacy Policy and may not use it for any other purpose.

LBC is very sensitive to privacy issues and is especially careful in its communications with children. LBC would never directly collect personal data from children without the parent's or guardian's consent.

Personal data pertaining to children and collected from their parents or guardians is used by LBC or other entities that provide technical fulfillment or other services to LBC (for example, services intended to improve our services/web sites, and fulfilling requests or administering promotions). These personal data are not sold.

Meanwhile, we urge parents or guardians to regularly monitor and supervise their children's on-line activities.

How we protect your personal data?

We take reasonable steps to ensure that the personal data we collect, use or disclose are accurate, complete, and up-to-date. We strictly enforce this Privacy Policy within LBC and we have implemented technological, organizational, and physical security measures to protect your personal data from loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction. We put in effect safeguards such as the following:

  • We keep and protect your personal data using a secured server behind a firewall, deploying encryption on computing devices and physical security controls.
  • We restrict access to your personal data only to qualified and authorized personnel who hold your personal data with strict confidentiality.
  • Any personal data that has been initially processed and stored by LBC. Using a secured connection, only authorized LBC personnel can then access and download your personal data from the system.

Where and how long do we keep your personal data?

All data are preserved in accordance with the retention policy of the Company and/or as required by a specific law or regulation.

Personal data are stored in our facilities located in the Philippines and Singapore and are retained in accordance with the above parameters, industry standards, and regulations, until you request that your personal data is deleted from our systems, databases, and hardcopies limited thereto. Once deleted, your personal data will be erased from any personal data records and completely removed from all the storage location.

The Data Protection Officer may, however, choose not to grant access or correct information based on the request following laws and regulations. He/she will give the individual a written notice that sets out the reason for the refusal.

What if there are changes in our Privacy Policy?

LBC may revise this Privacy Policy as the needs arise or when dictated by issuances of the National Privacy Commission or any amendment to the Data Privacy Act. Any change to this Privacy Policy shall be duly posted in this website and will take effect immediately. Data subjects are encouraged to periodically check for such updates, changes shall not be retroactively applied and will not alter how we handle personal data previously collected without obtaining your consent.

How you can access, correct and update the personal data we have about you?

To exercise your rights which include right to access, modify, erase and object to processing your personal data within a reasonable time after such request or should you have any inquiries, feedbacks on this Privacy Policy, and/or complaints to LBC or its websites, you may reach us through our “Contact Us” menu in these websites: lbcexpress.com or lbcexpressholdings.com, through a written letter or through an email to our Data Protection Officer (DPO).
